General Description: 

This bill amends provisions related to juvenile justice.

Highlighted Provisions: 

This bill:
provides that certain offenses are not subject to the time periods for termination and parole supervision for juvenile offenders; requires that a minor who is under the jurisdiction of the district court for an offense be held in a juvenile detention facility;
requires a minor who is committed to prison by the district court be provisionally housed with the Division of Juvenile Justice Services until the minor is 21 years old; amends definitions relating to minors who are adjudicated for certain kidnap or
sexual offenses;

Every child should have the opportunity to reach their full potential—even if they make a mistake while growing up. Second chances are important as children learn and grow into adulthood. This bill would ensure that the rights of minors are taken into custody are preserved.

Resolved, That Utah PTA encourage the State of Utah Division of Family Services and Division of Youth Corrections to establish a coordination and communication network among placing agencies and workers; and be it further

Resolved, That Utah PTA encourage the Division of Family Services and Division of Youth
Corrections to develop and enforce policies and guidelines that address the following
concerns:
1. Prior notice of student placement to all involved parties.
2. Appropriate transfer of student information.
3. Limiting the number of YIC students placed in each district according to the
availability of school district personnel and facilities and services to meet the specific
needs of each YIC student.
4. Appropriate placement of students within their home school district boundaries when
feasible.
5. Appropriate placement of students that safeguards the safety and well-being of all
students;

This bill will benefit Utah’s K-12 students by addressing the need for more mental health support in our school. Mental health is a top concern among parents, PTA leaders and teachers. We need to look to more ways of getting more help to our students.

Utah PTA is opposed to children's exposure to sexually explicit materials. Teachers and librarians work hard to support their students and provide them with appropriate materials. Putting criminal penalties on teachers for providing materials to their students is poor policy and will have a chilling effect on recruiting and retaining exceptional educators.

Impact on Children: 

This bill will have a detrimental effect on teachers and make it harder to recruit and retain good teachers and librarians. While PTA is opposed to exposing children to sexually explicit materials, subjective materials can be open to interpretation and this will cause confusion and uncertainty.
